1 Scope
These Terms apply to all visitors, users, and customers of firstpass.ca, including anyone who browses, places an order, submits information, or communicates with us.
These Terms apply to the fullest extent permitted by applicable law. Nothing limits any non-waivable consumer rights you may have. BC distance sales rules and consumer protections may apply to eligible transactions.

You agree to use this website only for lawful purposes that do not infringe the rights of others or restrict their use of the website.
You must not misuse the website, attempt unauthorized access, interfere with security, upload malicious code, scrape data without permission, or use the website in connection with fraudulent or unlawful conduct.
We reserve the right to suspend or terminate access where reasonably necessary to protect our business, customers, or legal rights.
3 Product Information & Availability
We aim to present products accurately. However, descriptions, availability, photographs, pricing, specifications, and release timing may change without notice. We do not guarantee all content will always be complete, current, or error-free.
We reserve the right to correct errors, update listings, or cancel orders where necessary.
4 Orders & Contract Formation
Product listings are an invitation to purchase, not a binding offer. A contract is formed only when we accept your order — by confirmation, processing, or shipping.
We reserve the right to reject or cancel any order for lawful reasons including pricing errors, suspected fraud, inventory shortages, or shipping restrictions.
If an order is cancelled after payment is captured, we will issue a full refund subject to payment processor timelines.
5 Pricing & Payment
All prices are in the currency shown at checkout. Applicable taxes, shipping, and other charges may be added at checkout or may arise after shipment depending on destination.
We aim to price transparently. Mandatory charges are disclosed as required by Canadian deceptive marketing law — hidden mandatory fees are not permitted except for government-imposed charges such as sales tax.
By submitting payment, you authorize us to charge the applicable amount. If a pricing or technical error occurs, we reserve the right to cancel or correct the order before shipment.
6 Pre-Orders & Early Supporter Offers
Some products may be sold on a pre-order or early supporter basis before inventory is fully available. Estimated delivery timelines are approximate. Production, import, customs, and carrier delays may occur.
By purchasing a pre-order item, you acknowledge that fulfillment may take longer than standard in-stock orders.
7 Shipping, Delivery & International Orders
We ship within Canada and to the USA, Europe, and other international destinations where available. Delivery dates are estimates only and are not guaranteed unless expressly stated in writing.
We are not liable for delays caused by carriers, customs, weather, labour disruptions, border issues, force majeure events, or other circumstances beyond our reasonable control.
For international orders, duties, VAT, customs charges, brokerage fees, and local compliance fees may apply. These are generally the customer's responsibility. Shipping from Canada to the USA may be affected by changing tariff conditions — we cannot guarantee the final landed cost.
Risk of loss passes to you upon delivery to the address provided, subject to any non-waivable consumer rights.
8 Returns, Refunds & Warranty
Your purchase is subject to our Shipping, Returns & Warranty Policy, which forms part of your purchase terms.
Where we offer a 30-day money-back guarantee or 5-year factory warranty, those programs apply only according to their stated conditions, including proper use and care.
Misuse, overheating, ironing, improper washing, abuse, or normal wear not caused by a manufacturing defect may void warranty coverage.
9 Customer Responsibilities

14 Limitation of Liability
To the fullest extent permitted by law, FirstPass™ Household Inc. and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages — including loss of profits, revenue, goodwill, data, or business interruption.
Our total aggregate liability for any claim will not exceed the amount actually paid by you for the specific product giving rise to the claim.
These limitations apply regardless of the legal basis of the claim, even if we were advised of the possibility of such damages.
15 Indemnity
You agree to defend, indemnify, and hold harmless FirstPass™ Household Inc. and its related parties from claims, liabilities, damages, losses, costs, and reasonable legal fees arising from your misuse of the website, breach of these Terms, violation of law, infringement of third-party rights, or misuse of our products contrary to instructions.
16 Force Majeure
We will not be liable for any delay or failure caused by events beyond our reasonable control — including natural disasters, pandemics, war, civil unrest, labour disputes, transportation disruption, customs issues, cyber incidents, power failures, supplier failure, or government action.
17 Governing Law & Disputes
These Terms and any dispute relating to them are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
Subject to any mandatory consumer rights, you attorn to the exclusive jurisdiction of the courts of British Columbia, Canada.
18 Severability, Waiver & Assignment
If any provision is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. We may assign our rights and obligations as part of a restructuring, sale, merger, or other business transaction.
19 Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the website after updates are posted constitutes acceptance of the revised Terms, to the extent permitted by law.
